The federal criminal court system is different from the state court system. While most attorneys can adequately represent you in State court, very few have the knowledge and experience to represent you in Federal Court.

Federal Crimes are prosecuted in the United States District Court and are subject to federal law. Federal cases are usually more complex than state crimes and require more preparation and experience than a State felony or misdemeanor crime.

U.S. Attorneys: U.S. attorneys are the prosecutors in federal matters, they are appointed by the President and answer to the attorney general of the United States. Assistant U.S. attorneys (AUSA's) are hired by the U.S. attorney and are responsible for handling the cases.

Judges: The judge handling a felony federal case is called a district judge or district court judge. District court judges are appointed by the President and confirmed by the Senate in accordance with Article III of the United States Constitution. District court judges do not answer to anyone; however, decisions by district court judges can be appealed to circuit courts of appeal and ultimately the United States Supreme Court.

Magistrates: Magistrate judges assist district court judges. Magistrate judges handle the initial court appearances in felony cases and are authorized to adjudicate misdemeanor and petty offenses. Magistrates generally handle the first appearance, bail and preliminary examination. For a felony, however, the law requires that the trial OR sentencing must be before a district court judge unless the defendant and the prosecutor stipulate or agree to have the matter handled by the magistrate judge.

Probation Officers: Probation officers work in either a supervision or investigation capacity. Supervising probation officers oversee and monitor convicted persons who are under court order to comply with probationary or supervised release terms. Investigation officers perform pre-sentencing background checks and interview defendants who have pled guilty or been convicted. Probation officers are hired through the court system and answer to the district court judges.

Federal clerks office: The district court clerk's office handles the filings and the administration of the paperwork. In the southern district of California, all filings are scanned into a computer system and are available for public viewing. Pre-trial services is the agency responsible for monitoring defendants on bond. Courtroom security and pretrial detention are the responsibility of the United States marshal's office.
